How do I qualify for Medical Marijuana?

Can I get a med card without a New York ID?

You will need to possess a valid New York state ID or driver’s license to apply for a medical card in New York. If you do not possess a New York state ID, you will need to be able to produce proof of residence within New York along with your out-of-state US photo ID.

How much is the cost?

The New York medical marijuana certification from NuggMD costs $149. The cost of the evaluation is also covered within this fee. Registering with the New York DOH carries an application fee of $50.

What is your refund policy?

How to Get Your MMJ Card in New York

1. SIGN UP

Create your account and fill out a quick, confidential questionnaire. It'll be sent to the first NuggMD doctor available for review.

2. TALK TO YOUR NEW PHYSICIAN

You'll meet face-to-face with your new doctor via video chat to evaluate whether your medical condition qualifies for New York's MMJ program.

More about Medical Cannabis in New York

New York has legalized recreational cannabis, but the Cannabis Control Board hasn't implemented regulations for recreational sales yet. Therefore, it's still necessary to have a Registry ID Card in order to purchase cannabis at a dispensary. However, the CCB has implemented a couple of new improvements to the program. As of Oct. 5, 2021, patients are allowed to purchase whole flower at dispensaries and purchase up to a two month supply of cannabis instead of just one month.

Other program improvements are scheduled to be implemented soon, including allowing for home cultivation and the elimination of specific qualifying conditions. Check back frequently for updates.

In July, 2014, Governor Cuomo signed S7923 into law. Also known as the Compassionate Care Act, this law allows registered patients in New York to purchase medical marijuana from state-authorized dispensaries. Unlike more lenient states, New York requires all medical marijuana patients to register with the program and be fully-approved before they can begin using cannabis.

Doctors who want to help their patients register with the program are required to take educational classes about medical marijuana, how the state's laws and regulations work, and how it's most commonly used. Once a physician has completed the required courses, they can recommend cannabis to patients that they are qualified to treat. In the recommendation, they are required to recommend a specific dosage and type of product, similar to an actual prescription.

Qualifying Conditions

A patient is required to have one of the following severe, debilitating or life-threatening medical conditions to qualify for the program:

  • HIV or AIDS
  • Amyotrophic Lateral Sclerosis (ALS)
  • Parkinson's disease
  • Multiple Sclerosis
  • Cancer
  • Spinal Cord Injury with Spacticity
  • Epilepsy
  • Huntington's Disease
  • Neuropathy

How to Become a Medical Marijuana Patient in New York

Becoming a registered New York medical marijuana patient is easy. It just takes a few simple steps. First, you'll need to create an account with NuggMD, then chat with your physician. Once they approve you and you've received your certification via email, you'll sign up with the New York State Department of Health at https://my.ny.gov/.

After you're approved by the state, you'll get a link to print out a temporary certification. You can use it to purchase legal medical marijuana from dispensaries right away. How to Become a Patient Caregiver in New York

A registered patient can designate one or two caregivers in New York. These caregivers can help their patients purchase and take medical cannabis. The designated caregiver must be 21 or over, and must be a New York resident. The caregiver also can't be the patient's physician.

The caregiver must wait till the patient's application is approved because they will need to use the patient's approval papers to finish the process. They must also receive their approval before they can begin their caregiving duties.

How to Renew A NY Registry ID

When it's time to renew your registry ID, you'll receive a notification that you're due for a renewal evaluation. You should start the process well before your certification is due to expire so you don't have a lapse in coverage, since renewal is not an instant process.

Your renewal will most likely need to take place one year after your certification, but there are rare cases where a patient is certified for a shorter time. Be sure to check your certification for the expiration date when you get it and mark it on your calendar.

If you have a caregiver, they won't be able to re-certify until you do, so you should set your appointment for about three weeks before you're due to expire just to give everyone time enough to get properly processed through the system again.

The good news is that the recertification process on the state's website is very easy. You'll only need to enter your new registration number, answer a few yes/no questions, and wait for your approval.

Patient Possession Limits

Patients can't cultivate their own cannabis in New York just yet, but they will be able to as soon as the CCB enacts the proper regulations. Purchase/possession limits are up to the doctor. Patients and caregivers are allowed to purchase a 60 day supply according to the amount indicated on their certification.

Prices are generally controlled by the Health Commissioner. Dispensaries propose prices, and the Health Commissioner approves them. Dispensary prices in the state are roughly double prices on the West Coast due to a limited supply and smaller program.

What if I'm only visiting New York? Can I still get a medical marijuana card?

New York visitors can sign up as temporary patients. Your card from a different state won't be valid in New York, so you'll have to see a registered New York physician to be evaluated. The process takes a few days to complete, so it's important to plan ahead before you travel. You'll need to show proof of temporary residency, such as a utility bill or rental agreement, and your certification is only going to be valid for the length of your stay.

Can I still be drug-tested for jobs if I'm a medical marijuana patient?

New York City doesn't allow pre-employment drug testing for THC unless it's for a safety-sensitive job. The rest of the state still allows pre-employment drug screening for now, but this will probably change in the future.

Can custody of my children be affected if I become a medical marijuana patient?

Unfortunately, New York doesn't have specific legal protections for parents who are also patients. You should consider your parental rights very seriously and perhaps even consult an attorney if this is a possible concern.

Can patients renew their cannabis certification before their current one expires?

Definitely. It's an excellent idea to do your re-certification a couple weeks before your current ID expires in case you run into any problems.
